The General Terms and Conditions apply in German. The English translation is for guidance only.
1. Scope
These General Terms and Conditions (hereinafter "GTC") apply to all services provided by Zugspitzpfoten - Hundetraining Katharina Voss (hereinafter "the mobile dog trainer") on the basis of a contract concluded between the mobile dog trainer and the customer for the implementation of dog training, unless otherwise expressly agreed in writing in individual cases or required by law.
2. Services
a. The mobile dog trainer offers the customer services in the area of mobile dog training and mobile advice on the behavior of and towards dogs (hereinafter also “mobile dog training units”).
b. The exact services and contents as well as the payment of the mobile dog training units are agreed upon individually between the mobile dog trainer and the customer.
c. The mobile dog trainer will use her knowledge and skills as best as possible during the mobile dog training sessions to help the customer to educate and train their dog. The mobile dog trainer will focus on the customer's specific needs and the dog's capabilities depending on its breed, age, gender and physical condition. The mobile dog trainer is not responsible for success, as this depends largely on the customer and other external factors (previous experience, environment, health, etc.) over which the mobile dog trainer has no influence.
d. The mobile dog training sessions usually take place at the customer’s premises or, if necessary, the mobile dog trainer will suggest another suitable training area (hereinafter also referred to as “training location”).
3. Conclusion and termination of contract
a. A contract is concluded through the written agreement of the exact services and contents as well as the payment for the mobile dog training units between the mobile dog trainer and the customer.
b. A contract ends when the agreed services are fulfilled, when the agreed term has expired or when it is terminated.
c. In accordance with the statutory provisions, a contract can be terminated by either party for good cause. The termination must be in writing. If there is a desire to deviate from this in individual cases, a separate written agreement is required.
4. Prices and payment terms
a. The prices for the mobile dog trainer's services (hereinafter also referred to as "payment") are published on her homepage. The prices are in euros, including statutory VAT. The specific remuneration based on published prices or, in individual cases, deviating prices is determined in an individual contract.
b.The mobile dog trainer can charge travel costs of 0.50 €/km for journeys by car to the customer or to another training location outside the local areas of Garmisch-Partenkirchen, Grainau and Farchant.
c. The mobile dog trainer is entitled to issue invoices weekly, monthly or quarterly. Payment of the invoice amount must be made within 30 days of receipt of the respective invoice, otherwise default occurs without the need for a reminder.
5. Appointments and cancellations
a. Appointments for the mobile dog training sessions are agreed in advance and individually with the customer (in person, by telephone, by email or WhatsApp) and are always binding with the agreement.
b. The mobile dog trainer reserves the right to make short-term changes to dates regarding training location, training schedule, and minor time delays. Such changes will be communicated to the customer as soon as possible.
c. The mobile dog trainer can cancel an appointment for an important reason, e.g. if the contractually agreed minimum number of participants for a group training session or a social walk is not reached. In these cases, she will inform the customer as soon as possible and arrange a new appointment with him.
d. The mobile dog training sessions generally take place whatever the weather. If the weather conditions make it impossible, significantly more difficult or dangerous for those involved to carry out the mobile dog training sessions, the mobile dog trainer will postpone the relevant dates if necessary without any additional payment being made.
e. If the customer is unable to attend, he or she is obliged to cancel appointments at least 24 hours in advance. In this case, the cancellation will be treated as a free cancellation and no fee will be charged. In the event of late cancellation or if the customer does not show up, the agreed fee will be due in full, unless it can be proven that the customer was unable to cancel in time (e.g. sudden injury to the dog).
f. If the customer is late for an agreed appointment, the delay is at the customer's expense and does not entitle the customer to a reduction in the fee or an extension of the agreed training time. The agreed fee is due in full.
6. Liabilities
a. The mobile dog trainer is liable for her own negligence and for the negligence of any vicarious agents. The liability of the mobile dog trainer is limited to damage caused by gross negligence or intent. The liability of the mobile dog trainer for damage caused by slight negligence is excluded. The only exceptions to this are liability claims for damages resulting from injury to life, body or health.
b. The customer is liable for any damage caused by the customer or the customer's dog to the mobile dog trainer or third parties or to the customer himself. The customer is obliged to take out dog owner liability insurance. The insurance certificate must be presented to the mobile dog trainer upon request.
7. Health and safety of the dog
a. The customer assures that his dog is healthy and free of contagious diseases and parasites when taking part in the mobile dog training sessions.
b. The customer is obliged to have his dog vaccinated against all relevant diseases before taking part in mobile dog training sessions. The vaccination certificate must be presented to the mobile dog trainer upon request.
c. The dog must wear a harness or wide collar during mobile dog training sessions. Chain, choke, spiked or spray collars as well as other aids that violate animal welfare are generally prohibited during mobile dog training units.
d. Training on a towing leash is only possible with a harness; leading a dog on a collar with a towing leash is generally prohibited during mobile dog training units.
8. Excluusion from participation
a. Female dogs in heat are not allowed to take part in group training/social walks during this time. This excludes individual training.
b. The mobile dog trainer may exclude the customer from participating in mobile dog training sessions if the dog poses a danger to itself, other dogs and/or people and/or if the customer disrupts the event and/or disobeys the mobile dog trainer's instructions in connection with this with the mobile dog training units.
c. An exclusion does not release the customer from his obligation to pay the agreed remuneration.
9. Data protection
The mobile dog trainer undertakes to treat her customers' personal data confidentially and only use it to carry out the agreed services. Otherwise, the data protection declaration published on the mobile dog trainer's homepage applies.
10. Copyright
The mobile dog trainer reserves the copyright to all training materials she creates. These documents may not be copied or distributed without the consent of the mobile dog trainer.
11. Miscellaneous
a. Changes or additions to these terms and conditions must be made in writing. Verbal agreements are invalid.
b. Should individual provisions of these terms and conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. Instead of the invalid provision, the valid provision shall be deemed to have been agreed which corresponds economically to what the mobile dog trainer and the customer were aiming for.have, comes closest.
c. The law of the Federal Republic of Germany applies.
d. The place of jurisdiction for all disputes arising from or in connection with these Terms and Conditions is the registered office of the mobile dog trainer.
